Land Development Ordinance

The Planning and Development Department administers the City of Clinton Land Development Ordinance (LDO), which regulates the use of property within the corporate limits and within the extraterritorial zoning jurisdiction outside the municipal boundaries. Development and Sign Permits are issued by the Development Administrator to ensure that the use of a building or sign in a particular location complies with the City of Clinton LDO. A Development Permit must be issued before land can be occupied or used, and no building, structure or sign shall be located, constructed, reconstructed, enlarged or structurally altered until a certificate is issued. A Development Permit is also required if there is a change of use in a building.

Board of Adjustment

The Board of Adjustment has authority to hear and decide appeals where it is alleged there is an error in any order, requirement, or decision on determination made by the Development Administrator in the administration of enforcement of the Development Ordinance. Any person affected by any decision of the Development Administrator is entitled to appeal to the Board of Adjustment. Any person requesting a variance from the provisions of the Development Ordinance can also make an application to the Board of Adjustment.

Flood Hazards

The Federal Emergency Management Agency (FEMA) has designated areas in Clinton that are subject to a 1% or greater chance of flooding in any given year as "areas of special flood hazards." Regulations within such districts are intended to reduce the:

  • Creation of Health and Safety Hazards
  • Disruption of Commerce and Governmental Services
  • Extraordinary and Unnecessary Expenditure of Public Funds for Flood Protection and Relief
  • Impairment of the Tax Base
  • Loss of Property and Life
