Rules and Regulations

Mission
The Clinton City Market Farmers’ Market was developed to provide a place for small family farms to sell their goods directly to consumers, to educate consumers about local farming and seasonal eating, and to encourage businesses to use and promote the use of locally grown ingredients.
General Control
The Planning and Development Department staff shall have the general control and supervision of the market, its building and the adjoining areas, and shall collect all fees and rentals from all renters and users of the market.
Removal
The Planning and Development Department staff and/or market manager shall have the authority to recommend the removal of any person from the market who is guilty of any violation of the market rules and regulations or who may be guilty of violating any ordinances of the City, County or State law, or who shall fail to obey any lawful orders of the Planning and Development staff and/or market manager.
Damage to Property
No person shall deface or damage the buildings, pavement, or other physical equipment of the market. Persons causing damage to market property shall be financially responsible for the cost of repairs or replacements. Such damage shall include, but not be limited to buildings, grounds, vehicles, and any other property owned and/or operated by the market.
Eligibility
Vendors must be the original producers of the fruits, vegetables, plants, herbs, flowers, eggs, baked goods, cheeses, jellies, jams, honey or other products that they intend to sell at the market.
Vendors must be the producer, producer’s agent, and/or relative of the producer to participate in the market.
Vendors are allowed to supplement their product offering with other locally grown produce, if at least 75% of the value of the produce offered, each market day, is grown by the vendor. Vendors will be required to clearly label all produce that is not grown by them, indicating the producer’s name and location of farm.
No person shall sell produce that is unsound or unwholesome or which fails to meet the standards or requirements of federal, state or local laws and regulations. All North Carolina regulatory laws applying to weights, measures, marking of containers, sanitation or other legal requirements will be obeyed by all vendors.
Electricity
Only usage of electricity approved by the market will be permitted.
Pets
Animals are not permitted on the market with the exception of aid dogs for the handicapped.
Hours and Days
The market will operate year round.
Market days are Wednesday from 3:30 pm until 6:30 pm and Saturdays from 8:00 am until 12:00 noon. Set up times are 2:30 pm to 3:30 pm on Wednesdays and 7:00 am until 8:00 am on Saturdays.
Vendors should not move their vehicles in or out of the market area during times when such movement would pose a danger to people in the shopping area. Vendors may not leave before closing time.
Display Area
Vendors must provide their own tables and chairs. If a vendor is located on the concrete areas on the outside of the building, they may set up a tent not to exceed 10’x10’ in size.
Each vendor is responsible for cleaning up the area around his/her selling space. All vendors must haul their trash at the end of each day to a designated dumpster location. On site trash receptacles are for customers only.
No animals may be sold or given away at the market.
No flea market/yard sale items shall be sold at the market. Only hand crafted items approved by the Planning and Development staff will be allowed.
Prices must be posted for all items sold. All vendors shall have a sign identifying their farm’s name and location. The sign shall not be larger than 2’x 3’.
Fees
Fees associated with the Clinton City Market Farmers’ Market have been suspended for 2005.
Hold Harmless Clause and Insurance
All authorized vendors participating in the farmers’ market shall be individually and severally responsible to the City for any loss, personal injury, deaths, and/or any other damage that may occur as a result of the vendor’s negligence or that if its servants, agents, and employees. All vendors hereby agree to indemnify and save the City harmless from any loss, cost, damages, and other expenses, including attorneys’ fees suffered or incurred by the City by reason of the vendors’ negligence or that if its servants, agents and employees; provided that the vendors shall not be responsible nor required to indemnify the City for negligence of the City, its servants, agents or employees. No insurance is provided by the City of Clinton to participants in the farmers’ market.
Violations
Violations of any of these rules as discovered by or reported to the Planning and Development Department staff will result in a verbal warning to the offender for the first offense, a written warning and two market days (one week) suspension for a second offense, and removal from the market for the third offense.
Conflicts between vendors and customers must be brought to the attention of the Planning and Development staff for resolution.
